Introduction

This “Privacy Policy” describes the privacy practices of TraceAir Technologies Inc. and our subsidiaries and affiliates (collectively, “TraceAir”, “we”, “us”, or “our”) and how we handle personal information that we collect through our website at traceair.net, as well as though social media, our marketing activities, our events and other activities described in this Privacy Policy. This Privacy Policy is intended for businesses and their representatives. We do not offer products or services for use by individuals for their personal, family or household purposes. 

Note this Privacy Policy does not cover data collected from TraceAir’s products and services, such as TraceAir’s software solution, for which we act as a data processor on behalf of our business customers. 

We may provide additional or supplemental privacy policies to individuals for specific products or services that we offer at the time we collect personal information. These supplemental privacy policies will govern how we may process the information in the context of the specific product or service.

Personal Information we collect

Information you provide to us. We may collect the following personal information from you (such as through our website or when you contact us) or from third parties:

  • Business Contact information, such as your first and last name, email and mailing addresses, phone number, professional title and company name.
  • Profile information, such as your username and password that you may set to establish an online account with us and preferences.
  • Registration information, such as information that may be related to a webinar or an event you register for.
  • Feedback or correspondence, such as information you provide when you contact us with questions, feedback, or otherwise correspond with us online.
  • Transaction information, such as information about payments to and from you and other details of products or services you have purchased from us.
  • Usage information, such as information about how you use the website and interact with us, including information associated with any content you submit to us.
  • Marketing information, such as your preferences for receiving communications about our activities, webinars, events, and publications, and details about how you engage with our communications.
  • Other information that we may collect which is not specifically listed here, but which we will use in accordance with this Privacy Policy or as otherwise disclosed at the time of collection.

Information we obtain from social media platforms. We may maintain pages on social media platforms, such as Facebook, LinkedIn, Twitter, Google, YouTube, Instagram, and other third party platforms. When you visit or interact with our pages on those platforms, the platform provider’s privacy policy will apply to your interactions and their collection, use and processing of your personal information. You or the platforms may provide us with information through the platform, and we will treat such information in accordance with this Privacy Policy. 

Information we obtain from other third parties. We may receive personal information about you from third-party sources. For example, a business partner may share your contact information with us if they believe you would be interested in learning about our products or services. We may obtain your personal information from other third parties, such as marketing partners, publicly-available sources and data providers, such as Zoominfo.

Automatic data collection. If you use our website or communicate with us, we, and our service providers may automatically log the following types of information about you, your computer or mobile device, and your interactions over time with us:

  • Device data, such as your computer’s or mobile device’s operating system type and version, manufacturer and model, browser type, screen resolution, RAM and disk size, CPU usage, device type (e.g., phone, tablet), IP address, unique identifiers (such as device identifiers), language settings, mobile device carrier, radio/network information (e.g., Wi-Fi, LTE, 3G), and general location information such as city, state or geographic area.
  • Online activity data, such as pages or screens you viewed, how long you spent on a page or screen, the website you visited before browsing to the website, navigation paths between pages or screens, information about your activity on a page or screen, access times and duration of access, and whether you have opened our marketing emails or clicked links within them.

Cookies and similar technologies. Like many online services, we use the following technologies:

  • Cookies, which are text files that websites store on a visitor’s device to uniquely identify the visitor’s browser or to store information or settings in the browser for the purpose of helping you navigate between pages efficiently, remembering your preferences, enabling functionality, helping us understand user activity and patterns, and facilitating analytics and online advertising.
  • Local storage technologies, like HTML5, that provide cookie-equivalent functionality but can store larger amounts of data, including on your device outside of your browser in connection with specific applications. 
  • Web beacons, also known as pixel tags or clear GIFs, which are used to demonstrate that a webpage or email was accessed or opened, or that certain content was viewed or clicked.

  • Technical operation. To allow the technical operation of the website, such as by remembering your selections and preferences as you navigate the website, and whether you are logged in when you visit password protected areas of the website.
  • Analytics. To help us understand user activity on the website, including which pages are most and least visited and how visitors move around the website, as well as user interactions with our emails. Referrals

Users of our products and services may have the opportunity to refer their business contacts (e.g., homebuilders, land developers, contractors, engineers) to us. If you are an existing user, you may only submit a referral if you have permission to provide the referral’s contact information to us so that we may contact them about our products and services.

How we use your Personal Information

We may use your personal information for the following purposes and as otherwise described in this Privacy Policy or at the time of collection:

Service Delivery. We use your personal information to:

  • provide, operate and improve our website, products and services;
  • establish and maintain your account or profile;
  • enable security features for our products and services, such as by sending you security codes via email or SMS, and remembering devices from which you have previously logged in;
  • facilitate social features of the website, such as providing chat or messaging functionality;
  • communicate with you, including by sending you announcements, updates, security alerts, and support and administrative messages;
  • understand your needs and interests, and personalize your experience with our website, products and services and our communications; and
  • provide support and maintenance for our website, products and services, and respond to your requests, questions and feedback.

As part of these activities, we may create aggregated, de-identified or anonymous data from personal information we collect. We may use this aggregated, de-identified or anonymous data and share it with third parties for our lawful business purposes, including to analyze and improve and promote our website, products and services.

Marketing. We may send you TraceAir-related marketing communications as permitted by law. You may opt-out of our marketing communications as described in the Opt out of marketing section. 

Compliance and protection. We may use your personal information to:

  • comply with applicable laws, lawful requests, and legal process, such as to respond to subpoenas or requests from government authorities;
  • protect our, your or others’ rights, privacy, safety or property (including by making and defending legal claims); 
  • audit our internal processes for compliance with legal and contractual requirements or our internal policies; 
  • enforce the terms and conditions that govern the website or otherwise; and 
  • prevent, identify, investigate and deter fraudulent, harmful, unauthorized, unethical or illegal activity, including cyberattacks and identity theft.

With your consent. In some cases we may specifically ask for your consent to collect, use or share your personal information, such as when required by law. 

How we Share your Personal Information

We may share your personal information with the following parties and as otherwise described in this Privacy Policy or at the time of collection: 

Affiliates. Our corporate parent, subsidiaries, and affiliates, for purposes consistent with this Privacy Policy.

Service providers. Third parties that provide services on our behalf or help us operate our website, products and services (such as customer support, hosting, analytics, email delivery, marketing, and database management services). 

Professional advisors. Professional advisors, such as lawyers, bankers, auditors and insurers, where necessary in the course of the professional services that they render to us.

Authorities and others. Law enforcement, government authorities, and private parties, as we believe in good faith to be necessary or appropriate for the compliance and protection purposes described above. 

Business transfers.  Acquirers and other relevant participants in business transactions (or negotiations and diligence for such transactions) involving a corporate divestiture, merger, consolidation, acquisition, reorganization, sale or other disposition of all or any portion of the business or assets of, or equity interests in, TraceAir or our affiliates (including, in connection with a bankruptcy or similar proceedings).

In this section, we describe the rights and choices available to all users. 

Access or Update your Information. If you have registered for an account with us, you may review and update certain personal information in your account profile by logging into the account.

Opt out of marketing communications. You may opt out of marketing-related emails by following the opt-out or unsubscribe instructions at the bottom of the email, or by contacting us at us-marketing@traceair.net. You may continue to receive service-related and other non-marketing emails. 

Cookies. Most browser settings let you delete and reject cookies placed by websites. Many browsers accept cookies by default until you change your settings. If you do not accept cookies, you may not be able to use all functionality of the website and it may not work properly. Analytics. We use Google Analytics and HotJar to help us understand user activity on our website.

Our website may contain links to other websites, mobile applications, and other online services operated by third parties. In addition, our content may be included on web pages or other online services that are not associated with us. These links and integrations are not an endorsement of, or representation that we are affiliated with, any third party. We do not control websites, mobile applications or online services operated by third parties, and we are not responsible for their actions. We encourage you to read the privacy policies of the other websites and mobile applications and online services you use.

Security practices

We employ organizational, technical and physical safeguards designed to protect the personal information we collect. However, security risk is inherent in all internet and information technologies and we cannot guarantee the security of your personal information.

International data transfers

We are headquartered in the United States and have service providers in other countries, and your personal information may be transferred to the United States or other locations outside of your state, province, or country where privacy laws may be different from those in your state, province, or country. 

Children 

Our website is not intended for use by children under 16 years of age. If we learn that we have collected personal information through our website from a child under 16 without the consent of the child’s parent or guardian as required by law, we will delete it. We encourage parents or guardians with concerns to contact us. 

Changes to this Privacy Policy 

We reserve the right to modify this Privacy Policy at any time. If we make material changes to this Privacy Policy, we will notify you by updating the date of this Privacy Policy and posting it on our website. If required by law we will also provide notification of changes in another way that we believe is reasonably likely to reach you. 

Any modifications to this Privacy Policy will be effective upon our posting the modified version (or as otherwise indicated at the time of posting). In all cases, your use of the website or submission of personal information to us after the effective date of any modified Privacy Policy indicates your acceptance of the modified Privacy Policy.
